Terms and Conditions

The purchase of products at the XogumMatcha Online Store is subject to the following terms and conditions:

  1. Object
    1.1 These General Conditions in force are intended, along with the order form and other elements referred to therein, to regulate the terms and conditions that will govern the provision of the Service at the XogumMatcha Online Store.
    1.2 The purchase of any product at the XogumMatcha Online Store implies the acceptance of these General Conditions of Online Sale.
    1.3 Access to the XogumMatcha Online Store is free of charge and does not require prior subscription or user registration.
  2. Product Information, Prices, and Content
    2.1 XogumMatcha reserves the right to modify, without prior notice and at any time, the information and commercial offer presented regarding: products, prices, promotions, commercial conditions, and services.
    2.2 The images illustrating each product at XogumMatcha may differ from the product subsequently delivered.
    2.3 The items for sale in the online store are subject to existing stock and orders will be processed in order of arrival. In the event of a stock shortage, temporary or permanent, the customer will be duly notified and suggested an alternative of products with similar characteristics.
    2.4 Under Portuguese law, product prices are indicated in € (euros) and include VAT at the legal rate in force, as well as the cost of packaging. The cost of transport to the customer is not included.
  3. Order and payment
    3.1 To make a purchase at the XogumMatcha Online Store, the user should ideally register as a customer. Once registered, the user can place their order by selecting the desired products. They must follow all the steps described therein so that the order is successfully completed.
    3.2 After confirming the order at the XogumMatcha online store, you must select the desired payment method from the available options: Multibanco, Visa, Mastercard, Paypal, among others. Any order placed at the XogumMatcha online store will only be processed after actual receipt of payment. The formalization of the order in itself does not constitute a reservation of products.
    3.3 After order confirmation at the XogumMatcha online store, an email will be sent to the contact address registered by the customer during formalization, with all details regarding delivery, billing, and payment information. If the customer does not receive the order confirmation email, they are requested to contact XogumMatcha via email at info@xogummatcha.com
    3.4 Changes to the conditions of non-shipped orders, or the cancellation of a non-shipped order, can be made when requested via email at info@xogummatcha.com.
    3.5 Orders placed by users from countries outside the European Union must be previously validated.
    3.6 Orders will only be sent after confirmation of stock and payment and will be processed in order of arrival.
    3.7 If an order cannot be satisfied in part or in full, the customer will be immediately contacted by XogumMatcha.
    3.8 After receiving the data regarding the order, the user has 3 business days to make the payment. If they do not do so within this period, the order will be automatically cancelled.
    3.9 The XogumMatcha Online Store provides the user with the possibility of making payment by bank transfer, for which they should contact the email address info@xogummatcha.com.
    3.10 Proof of bank transfer must be sent to the email info@xogummatcha.com.
    3.11 Payments are received in euros, regardless of the currency in which the transaction is carried out. Conversion fees for payments made in other currencies must be borne by the customer.
  4. Shipping costs
    4.1 The shipping cost is calculated based on the weight of the products, destination, and the total value of the order.
    4.2 The shipping cost is indicated in the shopping cart before the final validation of the order for deliveries to Mainland Portugal. For deliveries outside Mainland Portugal, the total shipping cost is calculated after confirmation of the customer’s order to the email info@xogummatcha.com.
  5. Delivery
    5.1 Orders will only be sent after confirmation of stock and payment and as quickly as possible.
    5.2 Order delivery will be made to the address indicated by the customer and in accordance with the delivery times of the transport company. Home delivery cannot be made to PO boxes. Deliveries can be made outside Mainland Portugal, provided the address is covered by the carrier’s delivery area.
    5.3 As the transport service is contracted from an external company, possible delays in delivery cannot be resolved by XogumMatcha, and in such cases, it is not possible to guarantee exact delivery times.
    5.4 If for any reason the customer cannot receive the order or pick it up at the location indicated by the carrier, the customer is requested to immediately contact the XogumMatcha Online Store via email at info@xogummatcha.com.
    5.5 All products sent by XogumMatcha must be checked at the time of delivery. If the customer finds that the order is damaged, they must immediately return it to the transport company, state the reason for return on the delivery note, and immediately inform the XogumMatcha Online Store via email at info@xogummatcha.com.
    5.6 If after delivery the customer finds that any of the items are not in conformity, they are requested to immediately contact XogumMatcha via email at info@xogummatcha.com, indicating the order number or the document number that accompanied the order, attaching images of the packaging as received and of all items, so that the situation can be resolved as quickly as possible.
  6. Returns/Complaints
    6.1 The XogumMatcha Online Store allows the return of products within a period of 15 days from the date of receipt of the order.
    6.2 To request an exchange or return, the customer is requested to contact XogumMatcha via email at info@xogummatcha.com, indicating the invoice number.
    6.3 The return of defective products and incorrect shipments is the responsibility of XogumMatcha, as are the shipping and collection costs, when the customer communicates this situation within a period of 15 (fifteen) days from the date of receipt of the product. Once the goods are received at our facilities and after validation of their state of conformity, the refund of their value will proceed.
    6.4 XogumMatcha is not responsible for deficiencies arising from incorrect use, negligence, and poor storage conditions by the Customer.
  7. Amendment of sales conditions
    These general conditions of online sale may be amended without prior notice and should therefore be consulted before placing any order.
  8. Data Protection
    The Customer must expressly declare that they authorize the collection or updating of their contact details for integration into XogumMatcha’s files for the purpose of customer management, commercial relations, as well as for sending advertising about products and services under the terms of Law No. 6/99, Law No. 41/2004, and Directive No. 2002/58/EC, through automated processing and profiling, by all available communication channels, including electronic means. Express consent must be given at the time of registration in the Online Store, in the option indicated for that purpose. Collected contact data will be kept for the period in which the purpose for which its processing was consented to is verified, or until the exercise of the right to object, rectify, and delete it. The data subject has the right to access the stored data free of charge, as well as to request its limitation, rectification, opposition, or deletion when, among other legal grounds, the contact data is inaccurate or no longer necessary for the purpose that motivated its collection. The holder also has the right to withdraw their consent at any time, without compromising the lawfulness of the processing carried out based on the consent previously given. If technically possible, they may request the portability of their data to another controller, in which case it will only be kept for the exercise or defense of claims. When any of the aforementioned rights are exercised, we reserve the right to keep the data exclusively for the purposes of declaration, exercise, or defense of a right in a judicial process. For the exercise of these rights or other additional questions you may have regarding data protection, you may contact XogumMatcha in writing at info@xogummatcha.com, providing authentication and proof of the data subject’s identity. We also inform you that you may file a complaint with the National Data Protection Commission if you consider that your rights have not been properly addressed. For more information, visit: https://www.cnpd.pt/. XogumMatcha does not transfer collected contact data to third parties. If there is a legitimate ground for its transfer, the Customer will be previously informed, and the identity of the recipients and the purpose of the processing of the transferred data will be transmitted. Transfer only occurs when third parties present sufficient guarantees of execution of appropriate technical and organizational measures, so that the processing meets the requirements and obligations arising from the applicable legislation on data protection and ensures the defense of the rights of the data subject.
  9. Declaration of Responsibility
    XogumMatcha expressly declares and guarantees that:
    a) It will properly treat the Personal Data it collects from its Customers within the scope of providing the Online Store Service; that they will be subject to lawful, confidential, fair, and transparent processing, and in a way that guarantees their security, namely obliging itself to protect this Personal Data against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure or access;
    b) It is in a position to ensure all appropriate technical and organizational measures so that the processing of Personal Data satisfies the requirements of the current Personal Data Protection Law, approved by Law No. 67/98, of October 26, and by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016, (“GDPR”), which entered into force on May 25, 2018;
    c) Personal Data is intended only for the execution of orders placed in the Online Store, with only those necessary, adequate, relevant, and limited to such purpose being collected;
    d) It will keep Personal Data accurate and up to date;
    e) It will not use the Personal Data to which it has access for any purpose other than that provided for in these Terms and Conditions;
    f) At the Customer’s request, it will destroy said Personal Data immediately and efficiently.
